City Fails to Meet Deadline, Iron Oak Files Motion to Compel

City Fails to Meet Deadline, Iron Oak Files Motion to Compel

City of Plam Bay has failed to meet the July deadline for Discovery, a process of answering questions posed by Iron Oak Attorney Burton Green. As a result, the Court may delay court date and possibly put the City in Contempt of Court.

Although attorneys from both sides have had open communication since the federal trial deadline dates were issued, the City has failed to meet the July 6, 1995 deadline for Discovery. These are our attorney's 23 questions that have to be answered by the City. Mr. Green, representing Iron Oak, has been generous in allowing additional time to the City. However, a complete response has not occurred and on October 3, 1995 he filed a Motion to Compel against the City in Federal Court.

On October 9, 1995, Mr. Green received a 4" tall stack of paper from the City which addressed only 5 of his original 23 questions. Until he has the balance of the information he cannot begin taking the depositions needed for the case.

The Federal Court may push out the trail date since the delay by the City will force Mr. Green to be constrained in meeting his deadlines. Although the City attorneys are no longer on the case, the information needed by Mr. Green must still come from records which the City has in their possession.

Legal Help Needed After Discovery

Mr. Green has asked that a general announcement be made to all those attorneys, legal aids, law students and the like that Iron Oak is going to need your help, but at this time there is little work that can be done. Please be patient.

For those with extensive computer graphic skills, we are going to need graphs, charts and the like, on the same level as the O.J. Simpson trial ("No, I'm not kidding," said Mr. Green). He would like to know if any Wiccans have access to such services, hopefully at reduced rates.

Jacque Omi Zaleski, HPS of Iron Oak, has been working on her 1996 travel schedule and would like to attend events across the U.S. where there is an interest in the case.
